Utah’s bill HB 372 threatened to not only raise taxes on e-cigarettes and smokeless tobacco products, but would have made it illegal to sell them over the Internet, or for brick and mortar stores to let their patrons sample their products before buying.  Unlike some similar recent bills, the Utah measure called out e-cigarettes, e-cigars and e-pipes specifically, and would have included anything ingestible which contained nicotine but was not specifically approved by the FDA as a smoking cessation aid. The legislation would even have applied to nicotine-free cartridges as the measure was worded.
Monday, the Utah House of Representatives defeated the measure 29 votes to 44, with two absent or not voting.
